Physician Clarification Text

The present clarification text is prepared by Dr. Lida Çiteli, Data Controller, within the scope of Article 10 of the Personal Data Protection Law No.: 6698 and the Communiqué Regarding Procedures and Principles To Be Followed During Fulfillment of the Clarification Liability.

1. Identity of the Data Controller

Dr. Lida Çiteli, Data Controller, shall be entitled to process your personal data within the framework of the following scope in accordance with the Personal Data Protection Law No.: 6698.

2. Objectives of Processing Personal Data

Dr. Lida Çiteli shall be entitled to process your Personal Data and Special Categories of Personal Data in line with the laws, consistent, limited with and to the extent of the purpose of processing, in consideration of the principles of justice and transparency, accurately and on the basis of current data available, by taking any technical and administrative measures, which are stipulated under he legislation for ensuring data security, and in conformity with basic principles, which are stipulated under Article 4 of the Personal Data Protection Law and Article 5 of the General Data Protection Regulation (GDPR), in the direction of the Conditions and Objectives for Processing Personal Data, which are specified under Article 5 of the Personal Data Protection Law and Article Nos.: 6 and 9 of the General Data Protection Regulation (GDPR), and within the scope of the objectives that are listed in the present Clarification Text.

1-YOUR IDENTITY DETAILS: Your name, surname, Republic of Türkiye ID Number and/or Passport Number and/or Provisional Republic of Türkiye ID Number, place and date of birth, marital status, sex, profession, signature and any other identity data that may define you.

2-YOUR CONTACT DETAILS: Your address (residence/business), telephone number (landline and/or monile numbers for home/business), e-mail address, IP address, social media accounts and any other contact details.

3-YOUR MEDICAL DATA: Your blood group, allergies, chronic diseases, venereal diseases, communicable diseases, operation history, permanently used drugs, data related with Covid-19, medical history, health reports, test and imaging test results, prescription data, body analysis and measurement data, skin analysis data, unhealthy habits and any other health data that are required for therapies and medical procedures that shall be provided to you.

4-YOUR PHOTOS AND VIDEO RECORDINGS: Your photos and/or videos that are taken before, during and/or after any medical procedure.

5-YOUR FINANCIAL INFORMATION: Your bank account number, IBAN number, credit card details, billing and invoice details and any other financial details.

6-YOUR TRANSFER AND ACCOMMODATION DETAILS: If you are a Health Tourist coming within the scope of the International Health Tourism, then your transfer details, round-trip details and hotel accommodation details.

Your personal data is processed by Dr. Lida Çiteli for below purposes in conformity with the Personal Data Protection Law and GDPR; to create a patient file, to conduct examination, preventive medicine, medical diagnosis, treatment and care services, to perform follow-up examinations on you after medical diagnosis and treatment processes, to manage complication processes, if any, to establish one to one contact with you, to manage appointment processes, to conduct patient satisfaction and request management, to fulfill legal and contractual liabilities, to keep your medical data, which must be preserved in accordance with relative legislation, for the specified period, to receive consultation services from other specialists, if required, in order to perform your treatment appropriately, to fulfill legal liabilities in conformity with the legislation related with International Health Tourism, to plan transfer and accommodation services of patients/clients, who arrive within the framework of Health Tourism, to announce innovations related with medical therapies and practices, to inform third parties medically on medical procedures that are performed, to conduct promotional activities in relation with medical services that are provided within the framework of the Health Tourism Incentive Legislation, to plan and manage financing of healthcare services, to fulfill liabilities, which source from the legal relationship that is established between physicians and patients, to maintain technical and commercial security and to fulfill public liabilities.

Your personal data shall be processed by Dr. Lida Çiteli under below conditions and circumstances in conformity with the Personal Data Protection Law and GDPR;

Your Identity Data shall be processed to conduct examination, preventive medicine, medical diagnosis, treatment and care services, to create a patient file, to conduct patient satisfaction and request management, to plan transfer and accommodation services of patients/clients, who arrive within the framework of Health Tourism.

Your Contact Details shall be processed to perform follow-up examinations on you after medical diagnosis and treatment processes and to manage appointment processes, and your Contact Details may also be processed to promote, notify and announce innovations related with medical treatments and procedures, provided that you express your explicit consent, to remind appointment dates of therapies that are provided periodically, and to send greeting and congratulation messages in special days.

Your Health Data shall be processed to conduct your medical therapies satisfactorily, to obtain consultation from another specialist, if it is deemed as required during the period of your treatment, to create a patient file, to preserve the information related with your health data, which must be maintained in accordance with relative legislation, and to fulfill legal liabilities that are included to the scope of applicable Health Law and Health Tourism Legislations.

Your Photos, Video and Sound Recordings shall be processed by Dr. Lida Çiteli to observe and manage the treatment process and also, to inform Health Tourist third parties, who wish to receive treatment in our country within the scope of the International Health Tourism, on medical services, which are provided to the same, and to promote various medical services.

Your Financial Data shall be processed to issue invoices for the purpose of controlling fee payments and to refund payments, in case any surplus payment is made.

Your Transfer and Accommodation Data shall be processed to plan transfer and accommodation services of patients/clients, who are admitted within the scope of the International Health Tourism.

Your aforementioned Personal Data and Special Categories of Personal Data shall be processed in the direction of aforementioned objectives and legislation in order to conduct your medical treatment and to fulfill any liabilities that are related with your treatment. If you fail to provide relative personal data, legal liabilities, which are assumed by Dr. Lida Çiteli, who shall provide you medical treatment services as the physician, shall not be fulfilled as required, and thus, your treatment and/or recovery periods may not be conducted satisfactorily. "

3. Methods and Legal Grounds for Collection of Personal Data

Your Personal Data shall be collected by following methods in connection with healthcare services that are provided by Dr. Lida Çiteli;

By using your health reports, laboratory and imaging results, your statements related with tests and medical data, which you provided after being admitted to the doctor’s office of Dr. Lida Çiteli for examination and treatment purposes in order to allow medical assessments to be made in relation with the treatment that shall be provided to you,

By ensuring that you complete the “Patient Explicit Consent Form” related with the treatment that shall be provided by Dr. Lida Çiteli,

By using the contact form that you completed on the corporate website of Dr. Lida Çiteli,

By using the e-mails that you shall send to the corporate e-mail of Dr. Lida Çiteli,

By using the photos/video recordings, which are taken before, after and/or during the medical procedure performed on you by Dr. Lida Çiteli,

In case it is required by you and if required; By using written/audio/visual (photos and/or video recordings) messages, which you may send to Dr. Lida Çiteli by using various remote connection service providers, from which we obtain service by accepting their Confidentiality Policies and International Transfer Principles, in order to perform online diagnosis and follow-up examination procedures by using remote access, and by using online audio/visual calls that you made via such applications,

By using the direct messages that you may send to Dr. Lida Çiteli’s profile accounts, which she may have within the body of various social media platforms (Instagram, Youtube, Facebook, Twitter, Linkedin etc.), servers of which are located in abroad and which you may have been already using after accepting their Confidentiality Policies and International Transfer Principles, and/or by using the responses you gave to Dr. Lida Çiteli’s messages on such platforms,

By using the data, which you transferred by allowing such data to be processed automatically via various panels, such as “contact us” or “get information” that are available under promotions and advertisement published by Dr. Lida Çiteli on various social media platforms (Instagram, Youtube, Facebook, Twitter, Linkedin, Google etc.), servers of which are located in abroad and which you may have been already using after accepting their Confidentiality Policies and International Transfer Principles,

By using the photos/video recordings, which are taken before, after and/or during the medical procedure performed/that shall be performed on you by Dr. Lida Çiteli in order to observe your therapy,

By using the log-recording devices (firewall) that are being used within the scope of technical measures taken in accordance with legislations, in case you wish to connect to the wi-fi network as a guest in the doctor’s office of Dr. Lida Çiteli.

Your Personal Data shall be processed according to the Personal Data Protection Law and GDPR so that Dr. Lida Çiteli may fulfill her contractual and legal liabilities fully and as required throughout the examination, preventive medicine, medical diagnosis, treatment and care services. "

4. Transfer of Personal Data

Dr. Lida Çiteli shall be entitled to transfer your Personal Data, which are collected in the direction of conditions and objectives that are included to the scope of the Conditions for Processing Personal Data stipulated under Article Nos.: 5 and 6 of the Personal Data Protection Law No.: 6698 and Article Nos.: 6 and 9 of GDPR, to below third parties and institutions for following purposes, to the extent required for fulfillment of relative objective, by signing required confidentiality agreements, and by maintaining any administrative and technical security measures that are in conformity with the legislation; to conduct and develop examination, preventive medicine, medical diagnosis, treatment and care services, to manage complication processes, to obtain consultation services from other specialists, if required, to fulfill administrative liabilities related with the International Health Tourism legislation, to plan transfer and accommodation services of patients/clients, who arrive within the framework of Health Tourism, to conduct promotional activities in accordance with the International Health Tourism Incentive legislation, to contact patients, to plan and manage financing of healthcare services, to fulfill liabilities, which source from the legal relationship that is established between physicians and patients, to maintain technical and commercial security and to fulfill public liabilities. In this context, your Personal Data and Special Categories of Personal Data, which are processed by Dr. Lida Çiteli, shall be transferred to below parties;

• To other specialists for consultation purposes,
• To insured employees,
• To suppliers,
• To Financial Advisors, Tax and Financial Advisors and Auditors,
• To Legal Advisors,
• To Server Hosting Providers,
• To the ""Clinical Management Software System"" Service Provider,
• To interpreters,
• To the Overseas Promotion Consultant,
• To the Support Management System (DYS) Supervisor
• To the Data Protection Officer,
• To the IT Consultant,
• To Tourism Agencies,
• To Public Institutions and Organizations authorized within the framework of laws, and
• To Judicial Authorities."

5. Rights of Data Subjects

Natural persons, whose personal data are processed within the body of the doctor's office of Dr. Lida Çiteli, shall hold below rights in accordance with Article 11 of the Law:

• To learn whether their personal data are processed,
• To request information on the processed personal data, if they are actually processed,
• To learn the purpose of processing personal data and whether such personal data are used according to the intended purpose,
• To be informed on third parties, to whom personal data are transferred domestically or in abroad,
• To request correction of personal data, if they are processed incompletely or incorrectly, and to request provision of information to third parties, to whom personal data are transferred, on the action that is taken in this context,
• To request deletion or disposal or destruction of personal data, in case grounds for processing the same disappear, although such personal data are processed in conformity with the Personal Data Protection Law and provisions of other relative laws, and to request the third parties, to whom such personal data are transferred, to be informed on the action that is taken in this context,
• To raise an objection to any results, which may occur against the data subject, after the analysis of processed data exclusively by automatic systems,
• To request compensatory damages, if the data subject suffers any losses due to illegal processing of personal data.

Data subjects shall be entitled to submit their claims related with aforementioned rights in conformity with the Communiqué Regarding Principles and Procedures for Applying to the Data Controller. You may submit your statement of claim, which includes your necessary identity details, by hand, by a notary public or by other methods that are specified by the Personal Data Protection Board.

Claims made by data subjects shall be assessed and concluded as soon as possible and in maximum thirty (30) days at no cost. In case assessment and decision-making procedures require incurring a different cost, then the fee, which is specified in the tariff announced by the Personal Data Protection Board, shall be considered as basis.
